ESRI Site License

Conditions For The Surrender of ESRI Products

Within the ESRI Site License the license terms of ESRI apply for licensees (departments of Technische Universität Berlin). Especially the following points should be taken into consideration:  

  • The Technical University of Berlin as licensee grants to the end user a non-exclusive, non-transferable and non-sub-licensable right of use of the software. The end user is obliged to keep the license material’s trademark rights, copyright notices, and other legal reservations unchanged. The end user is hereby explicitly prohibited to copy the software, except for back-up copies in customary use, or to distribute it commercially or non-commercially. The Technical University of Berlin reserves the right to use legal actions against the end user in case of violation of these terms.

  • The software may only be used by members of TU (employees and students) for the use within research & education. A commercial use is prohibited.
  • ESRI products may only be used on computer system of TU Berlin. The use on private computers even for official use is prohibited.
  • A participation right for the ESRI site license entitles for exactly one installation per product belonging to ESRI Site License. For further installations further participation rights are required.
  • It is prohibited to decompile, deassemble or reverse engineer the software.
  • The license administration mechanism may not be circumvented or disabled.
  • Further copying or distribution of the software or parts of the software to 3rd parties is prohibited.
  • The fabrication of copies on a data medium is prohibited.
  • The licensee accepts that the software is property of ESRI or their suppliers and that the software is a copyright protected asset. A deliberate or negligent violation of the copyright may result in major compensation claims.
  • Copyright labels or trade marks may not be removed or suppressed.
  • The licensee undertakes to prevent theft or other loss of the software and appendant items (e.g. documentation, dongles) and report about it immediately.
  • The termination of the software agreement can only be done by ordering a license cancellation within the TU 'Softwareportal'.
  • The software may not be used after cancellation or after end of distribution period (currently 20.04.2016) and has to be removed.
  • The licensee will try in all conscience to limit access and use of the software to TUB employees and to point out the terms of use to them.
  • TUB is not liable for the correct functioning of the software. TUB is not obliged to correct errors. TUB is not liable for 3rd party claims.
  • Ordering products within the Softwareportal that are part of the TU license agreement constitutes a formal contract between the customer and the TU. In relation to the customer only the conditions of use as specified in the adhering tubIT contract are applicable. Products acquired within TU agreements are excluded from the right of revocation.
